At its meeting of 25 November 2024, Council resolved to approve the Woollahra Development Control Plan 2015 (Amendment No. 28) with minor post exhibition amendments, and the amendment took effect on 2 December 2024.

Proposed Amendments

Council staff prepared a draft development control plan for land at 136-148 New South Head Road, Edgecliff which, if implemented, will guide future buildings to be constructed on the land. The draft development control plan provides guidance on matters such as built form, heritage and amenity, and facilitates a well-designed development.

We exhibited the Draft Woollahra Development Control Plan 2015 (Amendment 28) (Draft DCP) to introduce site specific controls for land at 136-148 New South Head Road, Edgecliff, which comprises the following lots:

  • Lot 1 DP663495 (No. 136)
  • Lot 1 DP1092694 (No. 138-140)
  • Lot 2 DP983678 (No. 138-140)
  • Lot A DP443992 (No. 142-144)
  • Lot B DP443992 (No. 146-148)

The site was subject to a planning proposal, which was finalised as Woollahra Local Environmental Plan 2014 (Amendment No 38) (LEP Amendment) on 17 May 2024. The LEP Amendment has the effect of permitting development on the site with a building height up to 46m and a Floor Space Ratio (FSR) up to 5:1 if the consent authority is satisfied of the matters set out in subclauses (3) and (6) of the LEP Amendment. The LEP Amendment also provides that a development control plan (DCP) is to be prepared for the land, unless the consent authority is satisfied that the preparation of a DCP is unreasonable or unnecessary, or the proposed development is relatively minor.

In response to the LEP Amendment, the Draft DCP has been prepared and was on public exhibition from 28 August to 29 September 2024. All submissions will be considered before it is taken back to Council for a decision to be made.

Proposed controls

Having regard to the site and its context, the Draft DCP establishes objectives and controls to guide the scale and nature of the future development that seeks to apply the height and FSR afforded by the LEP Amendment. The proposed controls address (but are not limited to):

  • Built form and design
  • Heritage conservation
  • Street activation
  • Public domain
  • Apartment mix
  • Car parking and access
  • Sustainability

They are designed to complement existing site-specific provisions in Clause 6.11 of the Woollahra Local Environmental Plan 2014 and will be contained in a new chapter of the Woollahra Development Control Plan 2015 under Part G: Site Specific Controls.

The Draft DCP only applies to the land identified above.

A hard copy of the exhibition material was available at the Woollahra Council Customer Service area, 536 New South Head Road, Double Bay – 8am to 4.30pm, Monday to Friday.

All submissions received during the exhibition period will be considered by Council.
