Woollahra Council invites your feedback on our draft Litigation Protocol Policy and Community Fact Sheet

Council has drafted a new Litigation Protocol Policy that would apply to all aspects of Council’s involvement in legal proceedings, including enforcement requirements and planning appeals before the Land and Environment Court.

The draft policy aims to establish an appropriate protocol to ensure that the community, resident objectors to development applications and elected Councillors are kept informed of the outcome of proceedings and have access to information on the outcome of those proceedings, especially those involving section 34 conferences before the Land and Environment Court.

A key objective of the draft policy is to enable the General Manager and Council staff to effectively and efficiently carrying out regulatory enforcement and planning legal proceedings on behalf of the Council in a fair and transparent manner.

We have also drafted a Community Fact Sheet to assist the community in understanding the development application appeal process and their rights in making representations to the Land and Environment Court. The Community Fact Sheet provides advice on the section 34 conference process, which allows the Court to hear from resident objectors at the start of a section 34 conference to understand their concerns.

The draft policy and fact sheet is on public exhibition from Friday 1 September 2022 to Friday 30 September 2022. Submissions must be received by close of business on Friday 30 September 2022.
