Update

The amendment to the Woollahra Section 7.12 Development Contributions Plan 2022 is now finalised and came into effect on 5 July 2024. It may be viewed here.

Overview

Council recently exhibited proposed amendments to the Woollahra Section 7.12 Development Contributions Plan 2022 to provide an annual update to the works schedule and include requirements to improve the process of calculating section 7.12 development contributions. The proposed amendments are contained in the Woollahra Section 7.12 Development Contributions Plan 2022 (Amendment No 2) (Draft Plan). Feedback were sought on the proposed amendments between 8 May 2024 to 9 June 2024.

About the draft amendment

Section 7.12 (previously 94A) of the Environmental Planning and Assessment Act 1979 allows councils to impose, as a condition of consent, a requirement that the applicant pay a levy of the percentage of the proposed cost of carrying out the development. For Council to impose a condition under section 7.12, a contributions plan must be in place.

The Draft Plan currently on exhibition will amend the current Woollahra Section 7.12 Development Contributions Plan 2022 (Amendment No.1) to include an updated works schedule and proposed changes to improve how section 7.12 development contributions are calculated.

The Draft Plan, if adopted, will require the applicant to have a suitably qualified person prepare cost estimate reports for development costs between $150,000 and $749,999. It will also clarify that any changes under section 4.55 and section 4.56 modifications to development applications are captured.

The Draft Plan applies to the whole Woollahra Local Government Area.

Helping to fund public infrastructure

The changes proposed will help Council capture section 7.12 contributions more accurately. Section 7.12 contributions are used to fund public infrastructure projects. These projects are listed in the work schedule of the Draft Plan.
