Overview
At its meeting of 11 September 2023, Council resolved to proceed with a planning proposal to list Lapin House, 2C Dumaresq Road, Rose Bay as a local heritage item in Schedule 5 and on the Heritage Map of the Woollahra Local Environmental Plan 2014 (Woollahra LEP 2014). Heritage listing aims to provide ongoing protection and recognition of the heritage significance of this site.
The public exhibition period to gather feedback on this planning proposal ran from Tuesday 24 October to Tuesday 21 November 2023. Your participation will shape Council's planning controls to ensure they reflect the views of the whole community.

About the planning proposal
The purpose of this planning proposal is to explain the intended effect of an amendment to the Woollahra LEP 2014. An LEP is a legal instrument that zones land and includes standards and controls to regulate the use and nature of development and the management of land. An LEP can also address matters of heritage conservation.
The proposed amendment to the Woollahra LEP 2014 involves the listing of a local heritage item in Schedule 5 of the Woollahra LEP 2014 and the associated heritage mapping. The property in question is known as Lapin House, 2C Dumaresq Road, Rose Bay (Lot A, DP 33652).
A detailed description of the heritage significance of the item is included in the supporting documents to the planning proposal, the heritage study and associated heritage inventory sheet.
Council has been authorised to use its delegation under section 3.36 of the Environmental Planning and Assessment Act 1979 to approve the LEP. The Department of Planning and Environment has classified this planning proposal as 'basic' as described in the Local Environmental Plan Making Guidelines (Department of Planning and Environment, 2022).

An LEP or ‘Local Environmental Plan’ is Council’s main legal document for controlling development and guiding planning decisions made by Council to ensure that growth and development occurs in a planned and coordinated manner consistent with Council and community expectations and needs.
An LEP contains land use zones which establish where residential, commercial, recreation and other uses can occur. It has development controls for buildings and land, including controls for height, floor space, subdivision and lot size. An LEP also provides protection for trees, heritage items, heritage conservation areas and environmentally sensitive areas.
An LEP is made by Council in consultation with the community, and approved by the Minister for Planning, according to the Environmental Planning and Assessment Act 1979 and Environmental Planning and Assessment Regulation 2000.
An LEP is reviewed every 7 to 10 years to ensure that the LEP is forward looking and suitably addresses current and emerging planning issues. Read the Woollahra Local Environmental Plan 2014.
The planning proposal affects the current land owners and may affect surrounding owners if they wish to carry out development in the vicinity of the proposed heritage items.
